Club By-laws

BY LAWS (Revised April 2015)

of

BUSH HILL PARK BOWLS, TENNIS & SOCIAL CLUB Ltd

These by laws should be read in conjunction with the
Memorandum and Articles of Association, dated 19th
October 1961, and as subsequently revised.
The following ‘By Laws’ are made in accordance with
item 65 of the Articles of Association.

1) The board of directors may delegate to the bowls tennis, darts and/or entertainments committees, and/or any other individual club member, the power to make by laws affecting the particular interests of the sections concerned, with such by laws so made to regulate a) rules of competition b) times of play c) conduct and dress of members and/or members guests, and or members or members guests engaged in sport (indoor and outdoor) and entertainments functions d) use and care of clubs sports equipment and any other property owned by or under the care custody or control of the club. All such by laws to be approved by the board of directors before publication, and to be amended by the board of directors as and where required in the interests of the club.

2) New members shall be liable to pay a joining fee at an amount designated by the board of directors.

3) The number of junior and juveniles admitted to membership of the club shall be determined by the board of directors. As and where required the board of directors reserves the right to require the written consent of parents or guardians in respect of any junior or juvenile membership application. Junior and/or juvenile members may only introduce guests for the purpose of playing tennis, bowls or snooker

5) Visitors to the club may be introduced upon signing the visitors’ book kept for this purpose. The member introducing such visitor shall be held responsible for the conduct and/or liabilities of such visitor, who shall pay to the bar steward (there being a box for this purpose) or relevant bowls / tennis representative a visitors fee in accordance with the sum determined by the board of directors

6) The parents or guardians of junior and/or juvenile members, or any senior member of the club introducing junior and/or juvenile guests to the club will be held responsible for the conduct of and/or any loss damage or injury occasioned by such junior and/or juvenile member and/or guest.

7) A visitor (guest) may not be introduced:

  1. a) Who has been a former member of the club and who has left in arrears of payment of his/her membership and/or who is otherwise a debtor to the club.
  2. b) Any former member whose membership has been cancelled by any previous or present

  1. c) Any person whether a junior, juvenile or senior guest who has previously been barred entry to the club or club grounds.
  2. d) Who is the child and/or ward of any member or guest who has been previously barred entry to the club or club grounds.
  3. e) Who has been rejected as a candidate for admission to club membership.
  4. f) Who being a former member of the club, has failed to comply with a ruling of the board of directors.

8) The club premises shall be opened and closed at such times as the board of directors may from time to time decide.

The hours of sale for intoxicating liquor shall be decided at the discretion of the board of directors, and shall be subject to amendment to suit the requirements of the licensing magistrates and/or legislation.

9) No payment for excisable articles shall be received from any person not being a member of the club. If such person shall make payment, he/she will be expelled from the club premises and the member so introducing him/her may be expelled from membership of the club or disciplined by the board of directors.

10) Refreshments and/or food may be supplied to members in accordance with tariffs determined by the board of directors. No member and/or guest shall introduce food and/or drink to the club without the prior authority of the board of directors.

11) Every member will pay every expense which they or their guests incur before they leave the club premises.

12) Any member damaging any property of the club or causing injury (by accident or design) shall make good the same, or reimburse to the club the cost of repairing or replacing such property as determined by the board of directors. For the purposes of this bylaw, the acts of guests will be interpreted as though such loss damage or injury had been occasioned by the member introducing such guest.

13) No animals shall be admitted to the clubhouse or grounds unless on a lead or under control, and such animals must be kept under control at all times. Members will be held accountable for any loss, damage or injury (whether by accident or design) occasioned to the property of the club, club members or guests to the club occasioned by such animals.

For the purposes of this by law, the animals of guests will be regarded as though admitted by the member introducing such guest.

14) All complaints and/or suggestions shall be made in writing to the secretary, or in a book retained by the steward for that purpose, and must be signed in full by the member making them.

15) The misconduct of any employee of the club shall in no instance be made a matter for personal reprimand by any member and/or guest, but all complaints against employees shall be addressed to the board of directors via the secretary.

16) In the event of injury to persons or loss or damage to property caused by an employee and/or contractor of the club, the complainant shall advise the secretary in writing. No approach should be made direct to the employee or contractor in question.

17) No bill, notice, advertisement or placard, other than notices relating to club activities, shall be posted or distributed in or about the club without the consent of the secretary. Any breach of this regulation will invite removal of such notices, and the member responsible may be removed from membership at the discretion of the board of directors.

18) Bicycles and/or wheeled toys shall not be brought into or ridden in the clubhouse, but shall be stored in the car park or any other space as properly designated by the board of directors. No responsibility will be accepted by the club for loss or damage to, or loss damage or injury occasioned by such property whilst within club boundaries. 3

19) No liability whatsoever is accepted by the club in respect of any property (of whatever description) owned by or under the care custody or control of members and/or their guests, or visitors.

20) Members and guests using the bar shall assume a reasonable standard of dress. This is defined as a minimum as ‘smart casual’. Vests and singlets do not come within this category. Bar staff may ask members or guests wearing vests or singlets to leave the bar. No hats, coats, baggage, sports equipment and/or sports bags shall be left within the bar area.

21) No musical instrument, or machine or appliance for making music shall be played in the club grounds or premises to the annoyance of other persons subject to the proviso that music or other entertainment may be approved on occasion where proper permission has been granted by the board of directors. Music or other entertainment in the bar will be provided ‘only at the discretion of the board of directors.

22) Any person causing annoyance to members, guests or any other person will be asked to cease such annoyance or leave the club premises only at the discretion of the senior officer of the club present.

23) No sweepstakes, raffles, draws entailing the sale of tickets on the club grounds or premises shall be organised by any member, guest and/or section or sub section of the club without the prior consent of an officer of the club. Profits from all sweepstakes, raffles or draws must be retained by the club. Any member or guest retaining a personal profit from such sweepstakes, raffles or draws shall refund to the board of directors any amount deemed appropriate, and the membership of that member, or member introducing such guest, will, at the discretion of the board of directors be cancelled, without rebate.

24) A charge as determined by the board of directors shall be levied on any member using the billiard tables, and for any other amenity of the club. Such charge must be paid by members before they leave the club.

25) The board of directors reserve the right to set aside the hail, kitchen, bar or indoor and outdoor sporting facilities of the club, for dances or social functions and/or sports functions, and to request on such occasions a donation to cover overheads for such facilities. Members are reminded that when they join in any entertainment, or sports event, against which a donation is appropriate, they incur the liability to pay any such donation as agreed by themselves and/or their guests.

26) The board of directors also reserve the right to set aside use of the hail, kitchen and/or other areas for the sole usage of the bowls, tennis, darts or entertainments committees or for any other activity.

27) All members are asked to carry their membership cards with them when they visit the club. The secretary or any director is empowered to request proof of membership from any person present at the club, or to require that any bona tide guest is properly signed in.

Those unable to substantiate their membership of the club or status as a bona fide guest may be asked to leave the premises.

28) No minor under 18 years of age shall be allowed usage of the club fruit machines, or be allowed to purchase tickets for draws, raffles or sweepstakes. Any minor breaching this regulation will be immediately expelled from the club, with his/her membership lapsed.

29) Any senior member of the club who shall knowingly allow any minor use of the gaming machines may be asked to leave the club premises, with his/her future membership of the club to be decided by a meeting of the board of directors, or of any sub committee of the board of directors so empowered by the main board.

30) No person under the age of 18 years shall purchase intoxicating liquors from the bar, and no senior member shall purchase intoxicating liquors for consumption by persons under the age of 18 years. 4

31) Children under the age of 14 years shall only be allowed in the bar if there is a function in the hall. They must be accompanied on such occasions by an adult member and shall behave in a manner so as not to annoy or interfere with those using the bar.

32) In accordance with the Articles of Association, the board of directors of the club reserve the right to interview any member considered to be in breach of any rule or by law of the club, and may, at their discretion, impose penalties upon members, or cancel the offending member’s membership of the club without rebate. The board of directors reserve the right to suspend the membership of, or deny entry to, or service to any member failing to comply with a board request for interview, or in the event that such member fails to pay any penalty imposed by the board of directors.

33) The board of directors of the club authorise any director, committee member, employee or member operating the bar to deny service to any person who, after request, fails to comply with any by law or rule of the club.

34) These by laws will be deemed to have been seen and understood by all members, and shall, at all times, be available to club members, with copies to be retained by the steward.

35) In the event of dispute concerning the interpretation of these by laws, the authority of the Secretary of the club shall be binding upon both members and directors of the club. Any member or director wishing to query the interpretation of any by law is entitled to write to the secretary requesting submission of said query to a meeting of the board of directors.
